Art. 1 - General provisions

  1. By browsing this area, the User accesses Nanapa & Bimboo, accessible via the url: www.nanapaebimboo.it. Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site indicated therein. These conditions may be subject to changes, the date of putting online is equivalent to the date of entry into force.
  2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by

Art. 2 - Object

  1. These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on Nanapa & Bimboo and do not, however, regulate the supply of services or the sale of products by parties other than the seller who are present on the same site through links, banners or other hypertext links.
  2. Before placing orders and purchasing products and services from different subjects, Nanapa & Bimboo suggests checking their conditions of sale.
Art. 3 - Conclusion of the contract

  1. To conclude the purchase contract, the User must fill in the form in electronic format and transmit it following the relative instructions.
  2. It contains the reference to the General Conditions of Sale, the images of each product and its price, the means of payment that can be used, the methods of delivery of the products purchased and the relative shipping and delivery costs, a reference to the conditions to exercise the right of withdrawal as well as the methods and times for returning the purchased products.
  3. Before concluding the contract, the User will be asked to confirm that they have read the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.
  4. The contract is concluded when Nanapa & Bimboo will receive the form filled in by the User, after verifying the correctness of the data contained therein.
  5. The User will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will be done by clicking on the "Place order" button at the end of the wizard.
  6. Once the contract is concluded, Nanapa & Bimboo will process the order for its fulfillment.

 Art. 4 - Registered users

  1. In completing the registration procedures, the User must follow the instructions on the site and provide their personal data correctly and truthfully.

The site recognizes that these identifiers constitute the system for validating the User's access to the Services as well as the only system suitable for identifying the User: the acts performed through such access will be attributed to him and will have binding effect towards him.
  5. The User will be obliged to maintain the secrecy of his access data, to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.

Art. 5 - Products offered

  1. Nanapa & Bimboo commercializza principalmente: Biancheria da letto per neonati e bambini prodotta artigianalmente, in tessuto di canapa o bambù dipinta a mano e personalizzata.

  3. The photographs of the handcrafted products presented on https://www.nanapaebimboo.it sono puramente rappresentative e non costituiscono elemento contrattuale. Le immagini fotografiche dei prodotti sono state realizzate in condizioni ottimali con strumentazione professionale. Tuttavia, il tono dei colori delle fotografie potrebbe variare a seconda dello schermo digitale sul quale le stesse fotografie vengono visualizzate.
  4. All our products comply with the product safety requirements of the Consumer Code (Legislative Decree no. 206/2005) as well as the UNI safety standards for the specific category of children's clothing.
  5. Small imperfections and discrepancies, which could arise, are the result of the craftsmanship of the product and do not involve the replacement of the same.


Art. 6 - Availability of products

  1. Being the products of Nanapa & Bimboo the result of craftsmanship and personalized, their availability on the site is related to the basic product, or without the required customization.
  2. Availability varies according to the type of product. By way of non-exhaustive example, the Swaddle require longer processing times, due to customization with natural colors which requires production times of 4-5 days, 3 of which are necessary for the natural drying of the color.
  3. For non-personalized products, processing times may be approximately 2-3 working days.
  4. Even after sending the order confirmation e-mail, there may be cases of partial or total unavailability of the products. In this case, the User will be promptly informed by e-mail.
  5. If the User intends to request cancellation of the order, by terminating the contract, Nanapa & Bimboo will refund the amount paid within 30 days from the moment in which Nanapa & Bimboo was aware of the User's decision to terminate the contract.

Art. 7 - Methods of payment and prices

  1. The price of the products will be that indicated from time to time on the site, except where there is an obvious error.
  2. In case of an error Nanapa & Bimboo will notify the buyer as soon as possible allowing confirmation of the order at the right amount or cancellation. In any case, it will not exist for Nanapa & Bimboo the obligation to supply what was sold at the lower price incorrectly indicated.
  3. I prezzi indicati sul sito sono comprensivi di IVA e non includono le spese di spedizione. In Italia la spedizione è gratuita per ordini superiori ai 80 euro. I prezzi possono subire variazioni in qualsiasi momento. I cambiamenti non riguardano gli ordini per i quali sia stata già inviata conferma dell’ordine.

  5. Nanapa & Bimboo offers its users the possibility to pay through the safest payment methods available online.

  1. These methods do not require registration and sensitive data are not managed by our server but directly by the online bank according to the most rigorous security standards. Financial and personal data are protected with advanced and updated electronic encryption systems.
  2. Once payment is received, Nanapa & Bimboo will send the User an e-mail confirming the order in which he will be notified that the payment has been correctly received and that his order is being processed.
  3. As soon as the order has been processed and prepared for shipment, Nanapa & Bimboo will send the User an e-mail containing the details of the shipment.
  4. SEPA BANK TRANSFER

10.1 To make purchases on Nanapa & Bimboo it is also possible to rely on the traditional method of payment by bank transfer. THE credit times are generally 2-3 working days and consequently shipping times will also be extended by a few days. To speed up this process you can send to Nanapa & Bimboo ae-mail with the photo of the accountant of the bank transfer. After verifying the correctness of the information and obtaining a reply from our bank, Nanapa & Bimboo will proceed with the customization and shipment of the requested product.

10.3 Please note that according to the agreements with your credit institution you may be charged additional fees for the use of your chosen payment instrument. Nanapa & Bimboo in no case is liable for such additional expenses.

10.4 Once payment is received, Nanapa & Bimboo will send the User an e-mail confirming the order to notify him that the payment has been correctly received and that the order is being processed.

10.5 As soon as the order for shipment has been processed and prepared, the User will be notified by e-mail.

11.1 After choosing to pay with PayPal, the User will be redirected to their page and will be asked to enter the details relating to access to their PayPal account or credit card in a secure electronic banking system, provided by PayPal.

11.2 In case Nanapa & Bimboo should not receive authorization from the issuer of his credit card, the User will be informed so that he can indicate another valid payment method.

11.3 Once payment is received, Nanapa & Bimboo will send the User an e-mail confirming the order in which he will be notified that the payment has been correctly received and that his order is being processed.

11.4 As soon as the order for shipment has been processed and prepared, the User will be notified by e-mail.

  1. Cash on delivery

12.1 It is also possible to pay cash on delivery directly to the carrier. This payment method is valid only in Italy and will have a extra cost of 10 EUR added to the normal shipping price regardless of whether the shipping is free or standard (6.5 euros).


Art. 8 - Delivery

  1. The production time varies according to the type of product. Some products require longer production and pictorial processing times such as, by way of example and not limited to, lo Swaddle, as described in art. 6, co. II of these Conditions of Sale.
  2. From the moment the product is shipped, delivery takes approximately 2-4 days. THE Shipping Times may also vary according to the payment method used. While the payment made by credit card and PayPal is immediate, the bank transfer involves a wait of 2-3 working days necessary for the actual receipt of the credit on our current account.
  3. Nanapa & Bimboo carries out shipments throughout the Italian territory and the European Union.
  4. Nanapa & Bimboo will only make deliveries to the User's home, provided at the time of purchase.
  5. Delivery is made, for the Italian territory, generally within 10 (ten) working days, and in any case, within the maximum term of 30 (thirty) days from the date of confirmation.
  6. As for the countries of the European Union, the delivery will be made in 15 working days, and in any case, within the maximum term of 30 (thirty) days.
  7. If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify the place where the order is located and how to agree on a new delivery.
  8. Qualora l’Utente non fosse in grado di essere presente nel luogo di consegna all’orario concordato,  Nanapa & Bimboo chiederà all’Utente di contattare il trasportatore per concordare una nuova data di consegna.
  9. Le spese di spedizione sono a carico dell’Utente e sono evidenziate esplicitamente al momento dell’effettuazione dell’ordine. In particolare, Nanapa & Bimboo applies the following shipping prices for its products:
  • Cost for shipping products throughout Italy € 8 VAT included.

  • In Italy, shipping is free for orders over € 80.

  • Costo per la spedizione dei Prodotti nell’Unione Europea è di € 15 iva compresa.
 

Art. 9 - Transfer of risk

  1. The risks relating to the products will pass to the buyer from the moment of delivery. The ownership of the products is considered acquired (the) upon receipt of full payment of all amounts due in relation to the products purchased, including shipping costs; (ii) or at the time of delivery, if this occurs at a later time.

 

Art. 10 - Warranty and commercial compliance

  1. The goal of Nanapa & Bimboo is that the User is truly satisfied with his order, and that each of our products sold has the effect of making the customer happy. Since all of our products are handmade, it is possible that there is a defect due to manual processing. Nanapa & Bimboo carefully check the products before leaving the laboratory, nevertheless, remind customers that, since they are FABRICS IN NATURAL FIBER and designs with NATURAL PIGMENTS, some imperfections or irregularities are characteristics of guarantee of the originality of the product itself.
  2. The guarantee of a Nanapa & Bimboo it is valid for two years from the date of receipt of the garment itself and refers to current European legislation. Deterioration caused by accidents, neglect, wear and tear and non-compliance with the washing and care instructions for the garment is excluded from the guarantee. In the event of the Guarantee being operational Nanapa & Bimboo the Customer will only be entitled to the replacement of the defective Products upon return of the same. The shipping costs necessary for the replacement of products are borne by Nanapa & Bimboo.


Art. 11 - Withdrawal

  1. Please note that our policy follows the following rules:

1.1 Personalized products: Nanapa & Bimboo does not accept the return of products that are not defective since they have been customized or created specifically for the User. As a result of this, to all Swaddle customized Not the right of withdrawal will apply being included in the categories referred to in art. 59 of the Consumer Code (Legislative Decree no. 206/2005), to which reference is made. In any case, Nanapa & Bimboo will always be available to help you. The User can always Contact Nanapa & Bimboo by phone or e-mail in case of doubts about your order. Since all products are customized to order, it is not possible to put them back on sale. It follows that, before placing the order, it is necessary to carefully check some details, not being able to change them at a later time:

  • Check the Text carefully - Swaddles are personalized with the baby's name. The User is required to check every letter of the child's name before confirming the order. Nanapa & Bimboo will not check every word that appears and cannot be held responsible for writing errors contained in the text indicated by the User.
  • Check the Swaddle design - The User is required to make sure that he has selected the Swaddle with the desired design. Also in this case, in the event of indecision, the User is advised to contact Nanapa & Bimboo.

1.2 Non-personalized products: the User has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 days pursuant to art. 57 of Legislative Decree no. 206/2005, to which reference should be made, starting from the date of receipt of the products. An essential condition for exercising the right of withdrawal is the substantial integrity of the asset to be returned

  1. To return defective products, the User must first contact our customer service using our contact form.
  2. Nanapa & Bimboo takes into consideration only the returned products that are sent by "registered letter with return receipt" and communicating the shipment by e-mail as detailed below in these General Conditions of Sale.
  3. The shipping costs for the return of the product (s) are charged to the User.
  4. In the event that, following adequate control over the product (s), Nanapa & Bimboo should it assess that the responsibility for the defect is at your expense, it will reimburse the costs of postal shipping.
  5. Only upon receipt of the product in its original state, Nanapa & Bimboo will be able to package a new product or fix the defective one.
  6. Attention: The product must be unused, otherwise we cannot offer remedies for the defect resulting from the handwork that we could provide. Where the defect is minor, we may suggest an alternative solution.
  7. The User who intends to exercise the right of withdrawal must communicate it to Nanapa & Bimboo by explicit declaration, which can be sent by recommended a / R at the address:

  1. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Nanapa & Bimboo will not accept cash on delivery packages. The shipping costs for returning the product are charged to the User.
  2. Once the product has been received, the defect found by the User checked and its integrity verified, Nanapa & Bimboo, in agreement with the User, will be able to replace it with a new product or fix the defective one. Shipping costs will be borne by Nanapa & Bimboo.
  3. If the product is not immediately available Nanapa & Bimboo will contact the User to communicate the expected delivery date of the new product. If the User is not willing to accept it, he will receive a refund of the amount paid (as indicated in the receipt / invoice) within a maximum period of 10 days. withholding the amount of the initial shipping costs which will be definitively charged to the Customer.
  4. The site will make the refund using the same payment method chosen by the buyer during the purchase. In the case of payment made by bank transfer, and if the User intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.

Art. 14 - Applicable law and competent court

Le presenti Condizioni Generali di Vendita sono disciplinate dal diritto italiano ed interpretate in base ad esso, fatta salva qualsiasi diversa norma imperativa prevalente del Paese di residenza abituale dell’acquirente. Di conseguenza l’interpretazione, esecuzione e risoluzione delle Condizioni Generali di Vendita sono soggette esclusivamente alla legge Italiana.
  2. Any disputes inherent and / or consequent to the same must be resolved exclusively by the Italian judicial authority. Where the User holds the status of Consumer, any disputes must be resolved by the Court of the place of domicile or residence of the same according to the applicable law (Article 33, paragraph II, letter u) of the Consumer Code).
